The client wishes to commission the artist to paint a portrait, pet portrait, or landscape. The appropriate model release form has been signed by the subject or the subject's parent, guardian, or owner (if a pet). By entering this contract the client acknowledges that they have reviewed other portraits/landscapes by the artist and are familiar with the artist's style and wish to have a fine art portrait or landscape of a subject completed by the artist in oils, acrylic or watercolor as specified below. The price of the commission portrait is $__________ plus artist's travel expenses and shipping, if required. Price does not include framing and / or matting. Once a non-refundable deposit of ⅓ of the total commision price has been paid, the artist will schedule the painting into her work calendar and schedule a photo session of the subject.

The artist will use the reference photos to help choose a composition. The artist will narrow it down to 2-4 photos and email ___ or text ___ those photos to the client for selection. When the client has selected a photo to work from, the final painting will be started. All photos and preliminary sketches, drawings, and paintings remain the property of the artist.


The final painting is usually completed within two to four weeks after the photo is selected and supplies are gathered. The client understands sketches are loose renditions of the subject and may not make sense until the paint is added. Any distractions (like texting) can disrupt the flow of the painting process so the artist usually does not show sketches to the client unless specifically asked. Upon completion, the artist will text or email the image to the client for review. When approved, the second payment of 1/3 the total commission price is due. The painting must dry before delivery. How fast it dries depends on thickness of paint and medium. When it is delivered, the final payment of 1/3 the total commission price and any travel and/or shipping costs are due.


Fees are only for the original artwork and do not include copyrights or reproduction rights, which remain with the artist.

Copyright Issues

Clarification of Artist rights as protected by the Federal Copyright Act of 1976 and the Federal Visual Rights Act of 1991:


Purchase of a copyrighted artwork does not transfer the copyrights. The copyright to reproduce the works in copies, to produce derivative work based on the copyrighted image, and distribute copies is retained by the Artist. Any transfer of this copyright must be in writing expressly identifying what rights are being sold and for what purpose.


That said, the artist loves to see her work in print so if you know an editor or reporter of a newspaper or magazine or TV station who would like to publish the artist’s work one time for a story or use as cover art, simply let the artist know and she will gladly grant permission as long as her name is mentioned as the artist in the caption or story. For websites and/or books, it depends on the situation so contact the artist (or have the editor or writer contact the artist) for permission. Feel free to give out the artist’s contact information for such purposes.


Works of art cannot be modified without the permission of the artist. Works cannot be distributed, mutilated, or modified in any way that would prejudice the reputation of the Artist.

Model Release Form
